Terms of Service

Terms and conditions for our educational services

1. Acceptance of Terms

By enrolling in courses or using services provided by SuperScher English Language School ("SuperScher," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms apply to all students, prospective students, website visitors, and users of our educational services.

2. Enrollment and Registration

Eligibility

  • Students must be at least 16 years old to enroll independently
  • Students under 18 must have parental or guardian consent
  • International students must hold appropriate visa documentation
  • Students must meet minimum English level requirements for certain courses

Registration Process

  • Complete and submit enrollment application with required documentation
  • Participate in placement assessment if required
  • Pay required fees according to payment schedule
  • Provide accurate and complete information

3. Fees and Payment

Course Fees

  • All fees are listed in Australian Dollars (AUD)
  • Fees may change with reasonable notice
  • Payment is due according to agreed payment schedule
  • Additional materials or examination fees may apply

Payment Terms

  • Payment must be received before course commencement
  • Late payment may result in suspension of services
  • We accept bank transfers, credit cards, and approved payment plans
  • Currency conversion fees are the responsibility of the student

4. Refund and Cancellation Policy

Cooling-off Period

Students have a 7-day cooling-off period from the date of enrollment during which they may cancel and receive a full refund minus any non-refundable fees.

Withdrawal Before Course Commencement

  • More than 28 days before start: 90% refund
  • 15-28 days before start: 75% refund
  • 7-14 days before start: 50% refund
  • Less than 7 days before start: 25% refund

Withdrawal After Course Commencement

Refunds are calculated on a pro-rata basis for the unused portion of the course, minus administrative fees. No refund is available after 50% of the course has been completed.

Special Circumstances

In cases of medical emergency, visa refusal, or other exceptional circumstances, refunds will be considered on a case-by-case basis.

5. Student Responsibilities

Attendance and Participation

  • Maintain minimum 80% attendance for all courses
  • Arrive punctually for all scheduled classes
  • Actively participate in classroom activities
  • Complete assigned homework and assessments

Conduct and Behavior

  • Treat staff and fellow students with respect
  • Follow school policies and procedures
  • Maintain academic integrity and honesty
  • Use school facilities responsibly

Visa Compliance (International Students)

  • Maintain valid visa status throughout studies
  • Comply with visa conditions and work restrictions
  • Inform the school of any changes to visa status
  • Maintain Overseas Student Health Cover (OSHC)

6. School Responsibilities

Educational Services

  • Provide quality English language instruction
  • Maintain qualified and experienced teaching staff
  • Offer appropriate facilities and learning resources
  • Monitor student progress and provide feedback

Student Support

  • Provide academic and welfare support services
  • Maintain student records and issue certificates
  • Report attendance to relevant authorities as required
  • Assist with visa and immigration matters

7. Course Changes and Cancellations

School-Initiated Changes

SuperScher reserves the right to:

  • Modify course schedules, curriculum, or teaching methods
  • Cancel courses due to insufficient enrollment
  • Change class locations or facilities
  • Substitute teachers when necessary

Notification

Students will be given reasonable notice of any significant changes. In case of course cancellation, students will receive a full refund or be transferred to an alternative course.

8. Academic Integrity

Prohibited Conduct

  • Plagiarism or unauthorized collaboration
  • Cheating on assessments or examinations
  • Falsifying academic records or documents
  • Unauthorized use of technology during assessments

Consequences

Violations of academic integrity may result in assessment failure, course failure, or dismissal from the school.

9. Disciplinary Procedures

Grounds for Disciplinary Action

  • Violation of school policies or procedures
  • Disruptive or inappropriate behavior
  • Poor attendance or academic performance
  • Breach of visa conditions

Progressive Discipline

Disciplinary measures may include verbal warnings, written warnings, probation, suspension, or dismissal, depending on the severity of the violation.

10. Limitation of Liability

SuperScher's liability is limited to the provision of educational services. We are not liable for:

  • Indirect, consequential, or incidental damages
  • Loss of opportunity, income, or career prospects
  • Visa refusals or immigration issues
  • Personal injury or property damage (except where required by law)

Our total liability shall not exceed the fees paid by the student for the relevant course.

11. Intellectual Property

School Materials

All course materials, curricula, and teaching resources remain the intellectual property of SuperScher. Students may use these materials for personal study but may not reproduce, distribute, or sell them.

Student Work

Students retain ownership of their original work but grant SuperScher permission to use student work for promotional or educational purposes.

12. Privacy and Confidentiality

Student information is handled in accordance with our Privacy Policy and applicable privacy laws. We maintain confidentiality of student records and personal information.

For international students, we may be required to report certain information to government authorities as required by law.

13. Complaints and Grievances

Internal Process

Students with complaints should first attempt to resolve issues informally with the relevant staff member. If unresolved, formal complaints can be submitted to the Student Services Manager.

External Review

If internal processes do not resolve the issue, students may escalate complaints to relevant external bodies such as education regulators or ombudsman services.

14. Force Majeure

SuperScher is not liable for failure to perform obligations due to circumstances beyond our reasonable control, including natural disasters, government actions, pandemics, or other force majeure events.

In such cases, we will make reasonable efforts to minimize disruption and provide alternative arrangements where possible.

15. Governing Law

These Terms of Service are governed by the laws of New South Wales, Australia. Any disputes will be subject to the jurisdiction of the courts of New South Wales.

16. Changes to Terms

SuperScher reserves the right to modify these terms at any time. Changes will be posted on our website and students will be notified of significant changes. Continued enrollment constitutes acceptance of modified terms.
